Terms of Service

These Terms of Service (“Terms”) govern your use of the QRCodeMaps platform operated by QRCodeMaps (“we”, “us”, “our”). By creating an account or using the service, you agree to these Terms.

1. Account Registration

  • You must provide a valid email address to create an account.
  • You are responsible for all activity that occurs under your account.
  • One person or organization may not maintain more than one account.
  • You must be at least 16 years old to create an account.
  • You must provide accurate information during registration. Accounts registered with false information may be terminated.

2. Acceptable Use

You agree to use QRCodeMaps only for lawful purposes. You must not:

  • Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Upload malware, viruses, or other harmful code disguised as map images.
  • Use the service to collect personal information from visitors without appropriate legal basis.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Use automated tools to scrape, crawl, or overload the service.
  • Resell access to the service without our written permission.
  • Use the service in any way that violates applicable local, national, or international law.

3. Content Ownership

3.1 Your Content

You retain all ownership rights to content you upload to QRCodeMaps, including map images, marker data, logos, and organization information. By uploading content, you grant us a limited license to store, process, and display your content solely to provide the service.

You are responsible for ensuring you have the right to upload and use any content you provide, including map images and floor plans.

3.2 Visitor Data

Scan and search analytics data collected through your QR codes is associated with your organization's account. You are responsible for informing visitors about data collection through your own privacy notices at your physical venue, where required by law.

3.3 Our Content

The QRCodeMaps platform, including its design, code, documentation, and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding beyond what is displayed as part of normal service usage.

4. Service Plans and Payment

4.1 Free Trial

Every new account starts with a free trial: 30 QR code scans within 90 days, with access to 1 site, 3 maps, 25 markers per map, 1 team member, and 7 days of analytics. No payment information is required. After the trial ends (either limit reached), you must subscribe to a paid plan (Starter, Professional, or Scale) to continue using the service. Your data is preserved during and after the trial.

4.2 Paid Plans

  • Three paid plans are available: Starter ($99/month), Professional ($349/month), and Scale ($599/month).
  • Each plan has specific limits on sites, maps per site, markers per map, team members, analytics retention, and feature access as described on our pricing page.
  • Plans are billed monthly or annually, as selected at the time of purchase. Annual billing is discounted.
  • Payment is due at the start of each billing period.
  • Prices are in US dollars and do not include applicable taxes, which will be added where required.
  • We may change pricing with 30 days’ notice. Price changes do not affect your current billing period.

4.3 Plan Limits and Feature Access

  • If you reach a plan limit (e.g., maximum number of sites or markers), you will not be able to create new resources until you upgrade or remove existing resources.
  • Certain features are available only on higher-tier plans: custom branding, advanced analytics, and QR code download require Professional or above; CSV export and integrations (Google Analytics, scan event API) require Scale.
  • Analytics data is retained according to your plan’s retention period (90 days for Starter, 1 year for Professional, 2 years for Scale). Data older than your retention period is not accessible.

4.4 Cancellation

  • You may cancel your paid subscription at any time from your billing page.
  • Cancellation takes effect at the end of the current billing period. You retain access to paid features until then.
  • We do not provide refunds for partial billing periods.
  • After cancellation, your maps become inactive until you resubscribe. Your data is not deleted.

5. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted service.
  • We may perform scheduled maintenance with advance notice when possible.
  • We are not liable for downtime caused by factors outside our control, including internet outages, hosting provider issues, or force majeure events.

6. Data and Backups

  • We maintain regular backups of the service database and uploaded files.
  • We are not responsible for data loss caused by your actions (accidental deletion of sites, maps, or markers).
  • We recommend you export important analytics data regularly using the CSV export feature (available on the Scale plan).

7. QR Codes and Public Content

  • QR codes generated by QRCodeMaps link to publicly accessible scan pages. Anyone with the QR code or link can view the associated map and markers.
  • You are responsible for the physical placement and security of printed QR codes.
  • We are not responsible for unauthorized use of QR codes that have been physically compromised, copied, or redistributed.
  • On the Starter plan, scan pages include “Powered by QRCodeMaps” branding. This branding must not be obscured, modified, or removed except on plans that include branding removal (Professional and above).
  • If your plan includes scan event API or Google Analytics integration (Scale), you are responsible for compliance with applicable data protection laws regarding data sent to third-party services.

8. Limitation of Liability

To the maximum extent permitted by law:

  • QRCodeMaps is provided “as is” and “as available” without warranties of any kind, express or implied.
  • We do not warrant that the service will be error-free, secure, or uninterrupted.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
  • Our total liability for any claims related to the service is limited to the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages (including legal fees) arising from your use of the service, your content, or your violation of these Terms.

10. Account Termination

  • You may delete your account at any time by contacting us.
  • We may suspend or terminate accounts that violate these Terms, with notice when practicable.
  • Upon termination, your data will be deleted within 30 days, except where we are required by law to retain it.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the service will be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
